Potomac River Group (PRG), Leesburg, VA, and Immigration Enforcement Solutions (IES), Scottsdale, AZ, have teamed to deliver up-to-the minute training on the Department of Homeland Security E-Verify system. Specifically, the PRG/IES team provides employers, human resource professionals, in-house or retained counsel and state/local governments with critical training and insights into the Department of Homeland Security’s recently activated Employment Verification Program, known as E-Verify. The E-Verify system, a web-based interface, provides employers a timely process to quickly obtain employment eligibility verification of newly-hired employees to work in the United States. E-Verify checks information provided by the employees on their Form I-9, and their supporting documents, against Department of Homeland Security (DHS) and Social Security Administration databases.
Employers participating in E-Verify exercise due diligence and good corporate citizenship. Employers who properly use E-Verify attain a “safe harbor” defense, in the event of an enforcement action by the DHS, U.S. Immigration and Customs Enforcement (ICE). E-Verify businesses may avoid significant legal, financial, and public relations damage for failure to comply with existing and anticipated immigration laws and regulations. Unfortunately, most companies will not be aware of I-9 employment verification issues until they become selected for a government review/investigation. By then, it may be too late to reverse damage caused by oversight, negligence or unknowingly accepting fraudulent supporting documents.
As a federal program, use of E-Verify is currently voluntary. However, as immigration reform is one of the most significant domestic policy issues facing America today, nationwide use of E-Verify will only be a matter of time. With legislation currently pending in Congress to mandate participation in E-Verify, it is in the best interests of employers and state/local governments to retain an independent source of E-Verify expertise as a preventative and prudent best practice.
